Terms and conditions for use of claireberlinerbenson.com website.

By using this (CBB) website you agree with the Terms & Conditions below.

1. PRICES

Prices are as stated on the website and are subject to change at any time without notice. 

2. PAYMENT & DELIVERY COSTS

CBB will only supply artworks and prints ordered via the website, email, phone or in person at our premises. We can only accept payments made online via Stripe, including shipping costs. All transactions are completed on a secure server. Sorry, we can’t accept any other form of payment.

CBB is not responsible for:

  • parcels damaged during shipping.

  • international duties or taxes. (All international duties and taxes are the responsibility of the buyer.)

3. DELIVERY TIMES

Orders are gathered once a week on Wednesday mornings for shipping the following Monday via Royal Mail Recorded ‘Signed For’ service for all UK parcels.

4. WEBSITE & ARTWORK AVAILABILITY

We make every effort to ensure the website is in full working order and the artworks displayed are available. However we do not guarantee the availability of the website, or that all goods on the site are available at all times. Please note, many prints are produced on demand and there may be delays out of our control. CBB will inform customers of any significant delay and will always refund if the goods become permanently unavailable.

5. CBB WARRANTIES

CBB is unable to provide any warranties in relation to the goods provided over and above its statutory obligation to provide goods of satisfactory quality in accordance with the Sale of Goods Act 1979 as amended by the Sale and Supply of Goods Act 1994.

6. RETURNS & EXCHANGES

Any prints and original artworks bought from claireberlinerbenson.com or at Claire Berliner Benson’s studio in Makespace are verified by us as the genuine article.

We can accept returns within 14 days of receipt / one month of purchase, whichever comes first. As long as the pieces are returned in their original condition with their original packaging and proof of purchase, CBB will exchange items for credit minus the shipping and packaging cost. Refunds are available at the discretion of the seller.

CBB cannot accept responsibility for loss or damage to returned goods whilst in transit. If you do have to return any item, please use a trackable system such as a parcel delivery or courier service. Please note, once orders have left the UK, CBB cannot be held accountable for damages or imperfections, and any refunds / replacements will be at our discretion.

Damaged or faulty orders - or not as described - will be refunded in full when we receive the returned work/s. Orders found to be faulty or not as described must be reported to claire@berlinerbenson.com, with photographs within 14 days of receipt, otherwise all guarantees and insurance are expired. CBB will endeavour to replace items after this, however this is not guaranteed.

Please note: All refunds will be processed in GBP. We are not responsible for exchange rate fluctuations.

If you have any problems with your order or wish to cancel/exchange your order, please contact us. We’re here to help. These terms and conditions do not affect your statutory rights as a consumer.

7. RESERVED ORDERS

You can reserve an artwork for 28 days with a deposit payment agreed with CBB. You will only be able to collect your artwork if you have paid in full. If you do not pay the remaining balance and collect your order within this time period, then we will restock your order and your deposit will be refunded, minus administration fees.

8. UNCOLLECTED ORDERS

CBB will happily hold your paid for prints and artworks for up to 4 weeks. Please collect your artwork within this time period. If you do not collect your product within this time period, then the artwork may be put back in stock, in which case you will be refunded for your artwork. 

9. INTELLECTUAL PROPERTY 

The rights in the designs and content of this website are owned by CBB. They are protected by copyright and other intellectual property rights. Do not copy, reproduce, modify, distribute, display, post or transmit any part of this site without permission. All art featured on this website is the property of CBB.

10. TYPOGRAPHICAL ERRORS

CBB reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. CBB reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, CBB shall issue a refund at the amount of the incorrect price.

11. PRIVACY & COOKIES POLICY

CBB acknowledges that it is bound by the Data Protection Act 1998 and that it will not disclose your details to any third party without your express written consent. 12. ALTERING TERMS & CONDITIONS

The CBB website is regularly updated and these terms and conditions may be amended from time to time. CBB reserves the right to change the terms and conditions without notice.
